By a complaint filed on February 24, 1990 in the District Court of the First Circuit, defendant-appellant Harry F. Wasson (Wasson) was charged with assault in the third degree, in violation of Hawaii Revised Statutes (HRS) § 707-712(1)(a).*fn1 After Wasson demanded a jury trial, the case was committed for trial to the Circuit Court of the First Circuit. Prior to trial, which began on May 6, 1992, Wasson twice moved to have the assault charge dismissed on speedy trial grounds. Both times he asserted Hawaii Rules of Penal Procedure (HRPP) Rule 48 (Rule 48) as a basis for dismissal, claiming that his trial had not commenced within six months of the filing of the charge as required by the rule.*fn2 Wasson's second motion also asserted his right to a speedy trial under the Hawaii and United States Constitutions.*fn3 The circuit court denied both motions.
