Description

The Board of State Bar Commissioners (hereinafter "the board") filed a complaint in this court, asking for disciplinary action
against the defendant, David B. Weber. Although the defendant was personally served with the complaint and order to answer,
he permitted the time for answering to expire. Upon motion of the state, the court entered an order on April 30, 1971, suspending
the defendant from the practice of law until further notice. Five days later, the defendant petitioned the court for leave
to file an answer and for vacation of the suspension order. The court accepted the answer, and appointed the Honorable Francis
X. Swietlik to serve as referee. The suspension order remained in effect. The referee found defendant guilty of unprofessional
conduct and recommended that the suspension order remain in effect and be extended to April 30, 1972. Partial payment of costs
were recommended in a sum not to exceed $400. David B. Weber is forty-nine years of age, a resident of Madison, Wisconsin, and has practiced law in this state since his
graduation from the University of Wisconsin Law School in 1950. He is married and has two children.
